Terms of Service

These Terms govern your use of synkivo.com and the Synkivo plugin for WordPress (the “Plugin”). By using the website or by installing, activating, or using the Plugin, you accept these Terms. If you do not accept them, do not use the website and do not install the Plugin.

1. About Synkivo

Synkivo is a product of WP Cloud Plugins, established at Kwikstaartlaan 42 (Box C2957), 3704GS Zeist, The Netherlands. Purchases, renewals, taxes, and refunds are administered by Freemius, Inc. as merchant of record.

2. License

When you purchase a Synkivo license, you receive a limited, non-exclusive, non-transferable, revocable license to install and use the Plugin on the number of WordPress sites your purchased plan allows.

The PHP/JavaScript code of the Plugin is released under the GNU General Public License v2 or later, as required by WordPress. Your rights under the GPL are not limited by these Terms.

Our trademarks, brand assets, and any non-code assets distributed with the Plugin (images, icons, fonts, documentation text) are not GPL-licensed and remain our property. You may not use them for promotion, redistribution, or derivative branding without our written permission.

3. Restrictions

You may not:

  • Resell, sublicense, or redistribute paid versions of the Plugin or paid license keys.
  • Remove, alter, or obscure copyright or license notices.
  • Use the Plugin on websites hosting adult content, illegal content, hate speech, malware, or content prohibited by the laws applicable to you.
  • Use the Plugin in a way that violates the terms of any connected cloud provider.

 

Nothing in this section limits rights granted under the GPL with respect to GPL-licensed code.

4. Updates and support

Active license holders receive updates and email-based support during their license period. Support is provided on a best-efforts basis. We do not commit to any specific response time, resolution time, uptime, or update schedule, and we may modify, add, or remove features at any time.

5. Cloud providers

The Plugin connects to third-party cloud providers including, but not limited to, Nextcloud, ownCloud, WebDAV servers, AWS S3, Wasabi, DigitalOcean Spaces, Cloudflare R2, Backblaze B2, MinIO, and S3-compatible.

You are responsible for your account with each provider, the OAuth scopes you grant, any fees they charge (storage, bandwidth, egress, requests), and your compliance with their terms. We are not a party to your relationship with any of them and we make no warranty about their availability, performance, or behavior.

6. Your responsibility

You are responsible for:

  • Maintaining current backups of all files, folders, and data accessed through the Plugin.
  • Securing your WordPress installation, server, hosting environment, and database.
  • Configuring user roles, permissions, and access controls in both WordPress and the connected cloud account.
  • Your visitors, customers, employees, and any other users acting through your site.
  • Complying with applicable laws for the data you process, including the GDPR where it applies.

7. Payment and refunds

All payments, taxes, invoicing, and chargebacks are administered by Freemius. Refund requests should be made through Freemius in accordance with their refund policy at the time of purchase. By purchasing a license, you also accept the Freemius Terms of Service.

8. No warranties

The Plugin and the website are provided “as is” and “as available”, without any warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, reliability, uptime, security, or non-infringement.

We do not warrant that the Plugin will work with any specific WordPress version, PHP version, hosting environment, theme, other plugin, or cloud provider. Statements in our marketing, documentation, or support communications do not constitute warranties.

9. No liability

To the fullest extent permitted by applicable law, we are not liable for any damages of any kind arising out of or in connection with the Plugin, the website, or these Terms, including but not limited to:

  • Data loss, data corruption, or unauthorized access to data;
  • Downtime or interruption of your site or your cloud provider;
  • Fees, charges, or penalties imposed by any cloud, hosting, or payment provider;
  • Lost profits, lost revenue, lost goodwill, business interruption, or any indirect, incidental, consequential, special, or punitive damages;
  • Claims brought against you by third parties.

 

To the extent any liability remains that we cannot lawfully exclude, our total aggregate liability for all claims combined is capped at the higher of (a) EUR 50 or (b) the amount you actually paid for your current Synkivo license in the twelve (12) months preceding the event giving rise to the claim. Your sole remedy is to stop using the Plugin and request a refund through Freemius.

10. Mandatory law

Nothing in these Terms excludes or limits any right or remedy that cannot be excluded or limited under mandatory law. This includes consumer rights under EU and Dutch law and liability for intent, gross negligence, or personal injury caused by negligence. Where a clause is invalid against a consumer, it remains in full force against non-consumer customers and the rest of these Terms is unaffected.

11. Termination

We may terminate your license immediately if you breach these Terms, if your payment is reversed or charged back, or if your use of the Plugin threatens the security, integrity, or legality of our business. On termination you must stop using the Plugin and remove it from your site.

12. Changes

We may update these Terms by posting a new version at synkivo.com/terms/. Where the change is material, we will give reasonable advance notice through the Plugin admin or by email. Your continued use after the effective date constitutes acceptance. If you do not accept the new version, stop using the Plugin.
